This Donation Drop Off Agreement, Release and Waiver is executed by the undersigned in favor of FAM Essentials and its past and present officers, directors, managers, employees, volunteers, independent contractors, agents, or representatives and assigns (collectively known as “FAM Essentials”) including Faith & Actions Ministry. FAM Essentials is dedicated to providing a safe and efficient delivery process for each of our valued recipients. I agree to the following Terms and Release:
1. Terms of Delivery: I agree to prepare all rooms in the house by clearing any and all items from floor and surrounding areas to provide space for the furniture being delivered.
2. Acknowledge: I acknowledge and understand that there may be some risks involved in the moving of furniture and home furnishings. I understand that damage can occur to floors, walls, doors, and painted surfaces. Property can be broken, dropped, scraped, torn, scratched, lost, etc., and indentation, scuff marks to carpets and hardwood flooring can occur. In some cases, furniture or household items may be in need of structural or cosmetic repair. Recipient acknowledges and accepts any and all items as-is. Recipients also accept any and all responsibility to insure that donated items are in safe operating condition.
3. Release and Waiver: I agree to allow FAM Essentials volunteers, representatives, employed movers and helpers to enter my home and place donated items. I hereby waive all monetary claims for damage or injury to myself or a member of my family, my furniture, furnishings and my accessories, and assume all legal financial responsibility myself for such. I shall not now nor in the future make any claim against FAM Essentials, its officers, directors, managers, employees, volunteers, representatives or helpers (the “Releasees”) for any injury to persons within my home or damage to my home or possessions located on my property. I, the undersigned, grant permission to FAM Essentials to use my name, likeness, voice and words, and the name, likeness, voice and words of the minor set forth below (if signing as a parent or guardian) in television, radio, films, newspapers, magazines and other media, and in any form not heretofore described for the lawful purposes and activities of FAM Essentials, including but not limited to advertising and appealing for funds to support FAM Essentials. I understand that I will not receive any compensation for the use of my name or likeness. By completing this Release and Waiver, you agree that the statutes and laws of the State of Tennessee, without regard to the conflict of laws principles thereof, will apply to all matters relating to this Release and Waiver. You agree that exclusive jurisdiction for any dispute with FAM Essentials resides in the courts of the State of Tennessee having jurisdiction over Wilson County, Tennessee and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of the State of Tennessee in connection with any dispute including any claim involving FAM Essentials or its employees, contractors, officers, directors or agents. I, on my own behalf and on behalf of Minor, hereby warrant that I have read this Liability Release and Waiver Form in its entirety and fully understand its contents. I, on my own behalf and on behalf of Minor, am aware that this Release and Waiver Form releases FAM Essentials from liability and contains an acknowledgement of my voluntary and knowing assumption of the risk of injury or illness. I, on my own behalf and on behalf of Minor, have signed this document voluntarily and of my own free will and agree to be bound by all its terms. I understand that this agreement shall be legally binding on the undersigned and their heirs, executors, administrators, successors and assigns.
